is there any option (as that was in old i.o.) where defensive army don't fight a field battle and attacker has to go back empty handed *hmm*

yes. go to command center and choose  to retreat. good luck!

V4 and older version - yes.
V5 - yes, but only for colonies retreat doesnt work in provinces.
