There are severalpossible reasons.
1. He is out of your 10x - in V2, you can attack only goldmines in 10x.
2. You have ip/pc match so system dont allaw you to attack him.

the player that attacked you started with 101 moral in the battle, he was a member of an alliance (possibly leader) this gives him additional moral in battles (minimum 105 starting moral) so you are right he was above your 3 x score range BUT he can still attack you and take a small reduction to his starting moral for the battle, the larger the difference in score the greater the penalty for attacking outside your 3 x range
